Orangeburg is outside of Duke’s service area. Duke asked the commission for permission to treat that city as “native load” customers, which would allow it to charge the same rates it charged municipal customers in Duke’s service area.
Plans to competeThe issue was important to Duke. It had planned to compete for municipal and cooperative customers outside its service area . But its bids could be competitive only if it could assure customers they would pay Duke’s regular rates — which are lower than those of its neighboring utilities. And Duke had ceded authority to the commission to rule on how to calculate the proper costs for wholesale deals.
The commission declined Duke’s request. It said it needs to maintain authority over calculating charges for wholesale purchases to make sure such deals don’t benefit Duke at the expense of its regular customers.
The commission ruled Duke could charge what rates it wanted, but the commission would retain its authority. That could have left Duke faced with the choice of charging Orangeburg higher rates or losing some profits from its native-load sales.
